Will expired spouse visa be honoured during EU Settlement application?

Hello.

Apologies if this has been answered already, but I could not find anything. We discovered last week that my non-EU wife can apply for the EU Settlement Scheme (through the Singh route) and then confirmed with their office. Her spouse visa for the first 2.5 years is expiring end of July. A paper based application can take six months or more they told us. During this time her visa will expire. Normally she would apply for the FLR-M and that covers her while she waits for a decision. If she is NOT doing that but instead applying for the EU Settlement instead, is she still covered while she waits?

I phoned both the EU Settlement and the UK Visa offices and they both said the same thing - they think, they assume that she should be, but they are not entirely sure. They gave me the email address of the public enquiries at the Home Office and I have sent a message there, but felt that you might have direct experience here.

Immigration route change is always a delicate and risky operation.

I don't have first hand experience of someone moving from FLR(M) to EU Settlement Scheme under Surinder Singh.

Usually British nationals invoke Surinder Singh for their partners when they come back to the UK form the EU.

You have to make sure that you qualify under Surinder Singh. If your application is rejected after the expiration of her current leave, she may have to go back home and apply for a spouse visa again.
