Section 5 - Residency Permissions

Post by snams » Thu Jul 16, 2020 4:04 pm

Hi all,

I’m an EU citizen living permanently, without interruptions, in Ireland since 2001 and in April 2019 I have applied for naturalisation.
The country I am from entered UE in 2007.

I’ve checked all the boxes in the application form bar a few mistakes and in October I was asked to rectify few sections and send them back.

Section 5 was one of them.
As far as I know, Section 5 does not apply to an EU citizen but I’ve sent back the date I entered the State with the mention that it was so far back that I don’t have the old passport anymore and I don’t have the passport number either.
I also did not sent back a copy of the report (residency calculator) as, again, did not apply to an EU citizen.

I’ve returned what was required back to the department only to receive another letter today stating that the case worker is still looking for Section 5 to be completed.

To be honest, at this stage, I do not know what they’re after or what to do.

The phone lines are closed and I’ve sent an email looking for more clarifications from their side.

If any of the members of this forum has any advice on this matter, it will be much appreciated.

Thanks!

That is incorrect. You MUST answer all questions. There is no such thing as 'section x does not apply to xxx'.

If you read the very first sentence in the guideline section of the application form, it says the following:
Answer all questions. If a question does not apply, write “n/a” in the box provided.
In fact, the only question that doesn't apply to you is Question 5.3. You can either answer NO or write n/a as instructed.
