FLR-LR Application on 10 year route

FLR-LR Application on 10 year route

Dear All,

Please find below my immigration history and advise me for my FLR-LR application.

• 15th Feb, 2009 granted entry clearance as a Tier 4 student valid 31st Oct, 2010.
• 2nd Oct, 2010 application LTR as a Tier 1 (Post Study work) migrant.
• 12th Oct, 2010 granted LTR as a Tier 1 Post study work migrant valid to 12th Nov, 2012.
• 12th Nov, 2012 application for LTR as a Tier 1 Entrepreneur.
• 16th May, 2013 decision to refuse LTR as a Tier 1 Entrepreneur migrant 23rd May, 2013 decision letters come out.
• 14th Oct, 2013 appeal lodged.
• 15th April, 2014 application for LTR as Tier 1 Entrepreneur migrant.
• 2nd July, 2014 application for LTR as a Tier 1 Entrepreneur migrant refused with no right of appeal.
• 17th May, 2018 PTA to the court of appeal to pursue the judicial review claim – Permission to proceed refused.
• 26th February, 2020 Application for FLR-LR submitted on 10-year route.

My section 3C leave expired since 2013 and I got a last decision from court of appeal on 25th May, 2018. Then I made a compaint against my former representative in 2019 who made to Legal Ombudsman and found that because of the firm's incomeptency in my Tier 1 Entrepreneur visa my application refused.

I would like to know that the court will consider my FLR-LR application on 10 year route because my last leave expired on 12th Nov, 2012.

You need to request your SAR file from immigration authorities to actually ascertain it.

No discretion will be granted as hiring a solicitor/representative is your personal choice instead being officially mandatory. Also UKVI has published its guidance as how and what need to make sure while choosing a representative.

FLR LR is for those who don't meet the English or LIUK requirements for ILR based on 10 years long residence and need a 2 year extension to give them the opportunity to pass the tests. It is not a route to accumulate 10 years ILR with 4 x FLR LR applications.

You also have not submitted an application to a 'Court'. You have submitted an application to UKVI/Home Office.

Why were your Tier 1 Ent applications refused so many times??

You also lodged your appeal very late in 2013, likely out of the timeframe.
