Resignation on tier 2 - Do I need to pay fee back in full?

Hi all,

I am currently on tier 2 general but resigning the company one and a half year before my 3-year visa expires. When I applied for my visa I had to sign a contract that I pay back the visa fee in full if I leave the company before my visa expires, no matter what. So they are deducting the visa fee from my final salary - I'll only get 600 pounds this month because of that.

Then I did some research recently and realised that most companies do deduct the visa fee in such a case but not in full, the amount reduces with time. As far as I see, for most companies if you work for 1.5 years then you'd only have to pay 50% of the fee back.

My question is, does anyone know if companies legally allow to deduct the fee in full?? Any tips will help, thank you.

This is an employment issue and everything to do with the contract you signed, which is legally binding.

This is not an immigration related issue.

So you mean company paid your Visa fees initially when you apply for Tier 2 visa?
