Switch to Tier 2 General visa from Tier 2 General Dependant visa

Post by Santhoshm » Wed Jul 29, 2020 4:04 pm

Hi All,

I am currently on Tier 2 General visa. My wife and son are on Tier 2 General Dependant visa. Now my wife's company is sponsoring her Tier 2 General visa so me and my son will switch to dependant visa. Could you please help me on the below questions

1. Since we are in UK and sponsorship process will start in the month of September,2020, should we actually come back to our home country after collecting the RCoS and then apply from home country or can we apply within UK only.

2. What are the set of documents required for my wife to switch her Visa to Tier 2 General.

3. What are the list of documents required for me and my son to switch to dependant visa

Please note ,our home country is India

Thank you in advance

Regards,
Santhosh

Your spouse will need to return to home country to apply. You and your son can stay in the UK and once she returns with Tier 2 General, you can switch to Tier 2 dependent visas.
2. What are the set of documents required for my wife to switch her Visa to Tier 2 General.
Same as what you would have to provide for your tier 2 general. https://www.gov.uk/tier-2-general/docum ... st-provide
3. What are the list of documents required for me and my son to switch to dependant visa
Similar to what they would have required when applying as your dependents. https://www.gov.uk/tier-2-general/family-members

Thank you for the response.

Could you please help me with another question

When should I inform my sponsorer about my visa switch? If there is no travel restriction then my wife and I will travel to India after collecting her RCoS and apply for visa from home country both of us ie she will be primary and I will be her Dependant.

But if there is a travel restriction, we will not be able to travel to home country, then after receiving her RCoS we will apply for the visa( primary and Dependants) from within UK . In this case when should I inform my company to cancel my RCoS ie after my wife receives her RCoS or before that.

Thanks in advance

You only inform your employer once you have been granted a dependent visa and you have your BRP to prove your right to work.
