ILR Dependent Process

Hi ,
I am currently eligible to apply for ILR in December 2019.
My husband and son who are currently my dependent (Tier 2 General PBS Dependent) , came to the UK in August 2016 on Tier 2 ICT visa. They became Tier 2 General PBS Dependent in May 2018.
It would be of great help if someone could clarify the below queries :

1. Do they need to apply for a ILR dependent Visa while I apply for ILR in December 2019.
2. Would they need to continue on PBS dependent visa even after my ILR gets approved.
3. When will they be eligible to apply for ILR.

On what basis are you applying for ILR, 5 years Tier 2 or 10 years long residence??

1. Depends on what basis you are applying for ILR.

2. Yes, but only if you apply for ILR based on PBS route tier 2.

3. May 2023, they need 5 years on PBS Dependent visa before they can apply for ILR.

They will remain under PBS dependant route until eligible for ILR in 2023

They apply for an extension shortly before their current visa expire. They will get a 3 year visa extension. IHS and visa fee payable again and you need £630 each for maintenance funds held for 90 days.

When they qualify for ILR, then they apply together on form SET(O).

CoS for PBS Dependent Tier 2 General extension in UK

Hi Team,

I'm holding ILR which has a validity until 31-12-2024.My dependants have their visa (Tier 2 General) validity till 29-09-2020. I am in the process of extending their visa as PBS dependant as they have not completed 5 years in the UK.
Could you please advise, if I can provide the same CoS(valid until 29-09-2020) that I used for my Tier2 extension/ILR as part of their application.

You need to complete the information the form asks for, which would be the last CoS and sponsor details you had on Tier 2. A CoS was NOT required for ILR as you are aware.
