PBS Tier 1 Dependent extension from UK

Post by ramgouda17 » Tue Jul 28, 2020 12:34 am

Hi

Can you please advise in regards to extension of PBS Tier 1 General Dependent visa extension from UK?

I am now a British Citizen (obtained via Tier 1 General-5 year route ILR, Citizenship)
My wife is currently on PBS Dependent Visa.
Her visa and travel history below.
20th June 2013 - Tier 1 General Dependent visa issued in India. Visa validity till Nov 2014
5th July 2013 - Arrived in UK. stayed in UK until end of Sept (around 80 days stay in UK)
July 2016 - Tier 1 General Dependent Visa issued in India. Visa validity till Nov 2017
Living in UK with me since 16th July 2016
2nd Oct 2017 - Applied for PBS Tier 1 Dependent Visa in UK by post.
7th Dec 2017 - PBS Tier 1 Dependent Visa issued in UK. Visa valid till 7th Dec 2020.

I now need to apply for her extension as she is not having 5 years of stay in UK to be eligible for ILR.

I have the following questions and hoping you guys can help.
1. Can I apply in first week of August by post (considering there is 8 week processing time) or will it be too early? Wife is planning to travel in Dec provided the Covid situation improves.
2. Form - Apologies but I am confused what form to use? I could not find the relevant form on gov.uk which I used last time to take a printout, complete and send to home office. Is it only online application now?
2. Maintenance of funds - £630.00 in cash savings for 90 consecutive days. From what day they will calculate the 90 consecutive days? Will they count backward from the day they receive the form (either by post or online) or on the day they make a decision on my application? Reason for asking this question is I will not have the required balance for couple of days if they count from the day they receive the application, assuming I send the application by post on 5th August. I may have to wait until middle of Sept to apply.

Thanks
RG

1. You cannot apply by post. You must apply online and upload all your supporting documents to the ukcvas portal before the ukcvas biomteric appointment.

2. Online only. https://visas-immigration.service.gov.u ... 1577027492

3. It's 90 days counting backwards from the date you apply and submit/pay online. You must wait till you meet the requirement for maintenance funds before you apply. If you don't meet the 90 days requirment, the visa will be refused.

Thank you for your response. Much appreciated.
  • In regards to the funds maintenance, can I show the funding from two sources. I have two bank accounts from two different banks in UK and the combined total from these bank statements will always be greater than £630 in the past 90 days.
Assuming, I meet the funding requirements now, can I go ahead and apply or will it be too early as her current visa is not expiring until 7th Dec 2020?
Thanks

Yes you can you two bank statements.

It doesn't matter when you apply, the extension will be a 3 year extension regardless.

It should not be a problem to use both statements.

Hi

I have a follow-up question please.

I am now completing the online form for my wife's extension as Tier 1 Dependent and now at the Immigration Health Surcharge site. Couple of questions on the form please.
I am holder of a British Passport. What should be my answers to the following two questions.
  • Visa Expiry Date - Should this be 3 years from date of application?
  • Passport Number - Should this be my British Passport number or my Indian passport number (which is now surrendered)
Greatly appreciate your help

1. I think on selecting British citizen the calculations of IHS will come correctly in comparison to ILR where 3 years has to be chosen.

2. British passport number

Hi

Thank you for your responses.

Even though I have stated I am British Citizen, the visa expiry date field is a mandatory field. It's not allowing me to leave blank. I entered it as 03/08/2023.

Under the 'The person you're joining or remaining with' section, I am filling my details.
Here 'Nationality' field is read only and is pre populated with 'British Citizen'.
Visa route- drop down. I chose Tier 1
Visa Type - drop down. I chose Tier 1- General
Passport number or travel document - I am providing my British Passport number here.

Can you please advise if this is correct?

Thanks

if you have filled the form correctly and if it still asks the date of expiry then I guess giving expiry of three years might be appropriate. Usually it never happens in case of flrm form where if the person is British citizen. Maybe croo1 correct me if my guess is incorrect.

Your answers are fine and the date for IHS should be 3 years (day 8/2023) from the date you submit to get the correct IHS fee.

Hi guys,

Sorry, another follow-up question Please.

In the checklist that I downloaded as part of the application submission, under the other documents section there are three items.
  • Documents showing you have had at least £630.00 in cash savings for 90 consecutive days - I am uploading my bank statements as evidence for the funding maintenance to support my wife's application.
  • Document showing you and your partner are living together (for example, a utility bill, council tax bill or
bank statement) - Providing Utility Bill
  • Statements from a personal bank or building society account (HSBC)'. Does this mean I also need to upload my wife bank statements to support the application? Or can I just ignore this as I am submitting my bank statements. Please advise
Thanks

Hi

Can you please advise on my last question? Do I need to submit my wife's bank statements as per the check list even though I am submitting my bank statements as evidence to support the funding maintenance requirements?

Thanks

Your statements are fine.

However, you can use her bank statements for the evidence of cohabitation for the last 2 years. You need more than just one utility bill. You need 3 to 6 sources in joint names or addressed to each of you individually, spread evenly for every 3 to 4 years.

Thanks CR001. Much appreciated.

We both are living together at the same address same as what's included in my wife's last PBS dependent visa extension which was in Dec 2017.

I have uploaded utility statement covering the period Apr to June 2020, which has both our names on it. I only receive statements covering 3 months period. To be safe side, I will upload three more statements covering the 9 months period prior to April 2020.

We don't have a joint bank account. But, as per your suggestion, I am now uploading her bank statements as well covering the period April 2019 to July 2020.

Hope these documents should be suffice as evidence.

thanks
RG

Really important that you find any letters or bills covering the whole 2 year period. This is mandatory. Anything can be used, council tax, any utility bills, tv licence, HMRC letter, NHS letters etc. Either in joint names or addressed to each of you individually. UKVI want to see evidence for 2 years with both your names.
