Need to go out of country for Tier2 general sponsored(from tier2 ict dependent)

Need to go out of country for Tier2 general sponsored(from tier2 ict dependent)

Hi There,
Myself(primary applicant) came here in UK in 2020 on ICT along with my wife and kid as dependents.
My wife has got full time job offer and they are offering Tier2 general sponsorship, we have couple of questions in regards to this, hope i get clarifications soon.
1) since my wife is on ICT dependent, would she need to travel out of country(india) to get sponsored by her new employer, i understand new rules would be in place shortly, is there any timeframe her new employer need to apply to eligible for new rules which incase she does not need to travel out side.? i heard it's this year autumn onwards, is it true.? New employer is ready to initiate sponsoring process rightaway, employer is big and standard company.
2) If the rule says she has to go out of country to get sponsored, but due to current covid times it is not advised to travel, what are her options( other than delaying application?).
3) Infact, she is working fulltime on ict dependent, but her current employer would start sponsorship process in jan(2021) as there seems to be lot of delay in applications processing due to less number of homeoffice workforce, is it true? Her current employer is very small, not sure if there any complications in sponsoring etc..
Any other advice would be greatly helpful.

She would normally have to apply from India yes. Not sure what new rules you are referring to??

Is her current employer an HO approved sponsor on the sponsor list?? There is some delay, but not months and months of delays. Most of the backlog seems to be clearly already.

It is not a 'new rule'. It is a concession for those who can apply if they have a visa valid up to 31st August. It will not be in place indefinitely either.

You can't bend the rules to suit your circumstances. She has a valid visa and can work, there is no urgency for her to apply for a visa immediately due to her visa expiring soon etc.

They have to apply for a sponsor licence and meet all the requirements and submit all the supporting documents to prove why they have to employ her as a non EU citizen and sponsor her, when she can work for them without any issues on a dependent visa.

HO is fully aware of ICT visa holders trying to circumvent the rules and jump onto other visas due to ICT not leading to ILR etc.

You should maybe wait till the new PBS routes come into force in January, there is some relaxation for ICT visa holders.
