Accommodation

Post by dmx1 » Fri Aug 14, 2020 8:19 am

I will be applying for ilr next month.

My partner and I have a son who's 4 years old.

3 of us live in a one bedroom flats. ( one bedroom plus living room)

Please does this constitute overcrowding? Thanks

There is no requirement to prove adequate accommodation for ilr.

Sorry I forgot to mentioned that I will be using pip/dla route for my ilr.

Please can you reassure me there's no proof of adequate maintenance for all ilr categories? Thanks

You still need to prove adequate maintenance with evidence.

Ilr(set m) form,

Since you started living in the UK have you spent time outside the UK.

Under this question, it said, Do not include holidays of 2 weeks or less. Include any periods of time you have spent on the Isle of Man, Jersey or Guernsey

I have been to Denmark on 3 different occasions spending less than 2 weeks each visit. Should I include those visit just to be on a safe side or ignore them according to the second paragraph?

Ignore it. ILR under the family route has NO absence limits at all

What about

E-ILRP.1.3.
(1A) In respect of an application falling within sub-paragraph (1)(a) above, the applicant must meet all of the requirements of Section E-LTRP: Eligibility for leave to remain as a partner (except that paragraph E-LTRP.1.2. cannot be met on the basis set out in sub-paragraph (c) of that paragraph, and in applying paragraph E-LTRP.3.1.(b)(ii) delete the words “2.5 times”).
Including
E-LTRP.3.3.
(b) the applicant must provide evidence that their partner is able to maintain and accommodate themselves, the applicant and any dependants adequately in the UK without recourse to public funds.
and E-LTRP.3.4.

Appendix FM Section 1.7A - Adequate maintenance and accommodation
Example A
The accommodation has 1 room available as sleeping accommodation. The house would be occupied by a couple, and one child aged 5. The housing is overcrowded and therefore does not provided adequate accommodation under the Immigration Rules because only 2 people are permitted to sleep in the property without it being overcrowded whereas 2.5 people wish to sleep there.

Example B
The sponsor rents a one bedroom flat with a living room. There are 2 rooms available for sleeping. His wife wishes to join him in the UK. The housing is not overcrowded as up to 3 people are permitted to sleep at the property without it being overcrowded.
