Critical Skills Refused- Appeal Help

Hi all,

I applied for a Critical Skills Work Permit that was refused. I work for a digital marketing agency and work with many international clients so my work falls under the international marketing expert position. I'm appealing the decision as it states that my job description is more suited to the general permit. I've been at my job for about 2 years on the 1G stamp so my job doesn't meet the Labor Market Test criteria.

The appeal is the best chance. Is there any advice or items to submit with the appeal? Thanks in advance.

Obviously every application is different so we won’t be able to assess what the best option is without knowing the nitty gritty details.

If I am just to speculate based on what you described here, I can get a sense of why your application was refused:

- You are currently on Stamp 1G and have been on it for 2 years. This means you graduated from college only 2 years ago.
- You said you applied under ‘International marketing expert’. That is way too big a title for you. I would not call anyone who has only graduated 2 years ago an ‘expert’ in any industry.
- The refusal reason adds onto that. It says your job description suits more to the general permit. That means you have not been able to demonstrate what an ‘expert’ should be expected to do in your job, and sounds more like a number of non-critical job roles that most people should be able to do.

If you want to appeal the decision, you would have to show how critical your role is for your company, how irreplaceable you are to your company, why your job description cannot be done by an average EU worker, and how your college degree would have helped you outperform others who don’t have this degree.

A recommendation letter from senior personnel on your company may in some way help you, but you have to word your job roles very carefully.

I don’t want to be pessimistic, and I am only speculating based on your two lines of your post, but to be honest I just don’t feel that category is for you. Are there no other categories that are more suitable to graduates in your industry?

As a recent graduate working in digital marketing, you are not going to qualify as an international marketing expert. And you are not going to win critical skills permit on appeal. You can't possible show that your job can't be done by any of the thousands upon thousands of EU digital marketers.
Sorry, but honestly I wouldn't even bother. You need to try a different route.

Hi,

Thank you to both of you for the feedback. What alternative routes would you suggest? There are only two marketing related positions on the Critical Skills List and this is the best option for me as I don't work in sales and/or speak another language. I'm open to any other suggestions.

You simply don't qualify for a critical skills permit. And since I don't think there is an shortage of digital marketers in Ireland, it's doubtful you would get a general employment permit either, thought you can try.

Hi,

My company recently announced that they would be having a round of layoffs stemming from the pandemic. I'm worried that this may include my position. I was recently granted a Critical Skills permit but won't be able to go to INIS before the layoffs are made. If I'm made redundant would I still be able to apply for the Stamp 1 with the work permit. You're usually permitted six months to get a job if made redundant but I don't know how that applies for immigration.
