Need some advice as not quite sure what is the best option. We are a family of four and have stayed in South Africa for 40 years. Wife and two children are full British Citizens as the children were born in UK as wife went over to UK during maternity leave and paid for birth of children in UK and has proof of payment. Husband is South African and we have been married for 12.5 years. We have both lost our jobs as we were commercial airline pilots. We have sold our house and using that as CASH savings ( More than 62500 UK Pounds) to meet the financial requirement . We want to make UK our home and apply for a spousal visa for the husband.
There are some timing issues that I am not sure about. We both have an ICAO ATPL commercial pilot license and have been flying commercial jets for the past 12 years. In order to convert that license we have to sit 14 exams in London to obtain a CAA/EASA license as well as pass a Class 1 Medical also in London. We did sit similar air exams in South Africa so it is just study time and money required to do them again. Approx 6 months as some of the exams are tricky.
We had intended to apply for a spousal visa now before 1 Oct and if the visa was approved the wife and I come to UK to do the medical and sit some of the exams and look around for areas where we would want to stay permanently. That would probably be in Dec 2020 or Jan 2021
We would want to come back after say 2 weeks to continue studying and would return in May 2021 with our children and sit the remainder of the exams I know that the BRP allows us to enter and exit but not sure what UK Govmnt would say when we returned in May 2021 with the entire family.
We didn’t want to apply for the spousal visa 3 months before May 2021 as we are concerned that they change rules after Brexit transition period ends and we wanted to avoid the IHS increase on 1 Oct.
We think that there is no job requirement when we apply for the spousal visa as we satisfy the financial requirement but not sure if that is true
