Visitor visa - options

Post by MDNJ101 » Wed Sep 09, 2020 8:20 pm

Hi does anyone know what options there are for my partner to apply for a fiance visa whilst in the UK on her visitor visa?

If that's not possible are there any other visas she could apply for without the need to return to China?

Thanks

She cannot. A fiance visa can only be applied for outside the UK.

Why can't she return to China to apply in the normal way if she is currently in the uk? If she could travel here, then surely she can travel back. Or are you intent on finding a way to try and circumvent the immigration rules?

How long has she been in the UK on a visitor visa?

You previously stated she was applying from outside the UK? You were already advised against trying to change to another visa while in the UK as a visitor. The advice does not change.

She isn't in the UK.

We have not seen each other since last Christmas.

The question was about whether there is a way, if she comes here on her extant visitor visa, she can extend that and apply for settlement in any other way.

We are almost ready to apply for the fiance visa (from China) but we are worried that if there is another lockdown during the application consideration period we will be prevented from seeing each other for another long period.

As she has a visitor visa and could get one for her son quickly I am trying to ascertain if there is any other settlement route available once she is actually here. We are desperate to be together. I'm just trying to do the best thing.

There isn't any. There is no loophole or obscure rule that ukvi keeps secret. She simply needs to apply from China.

Not looking for a loophole or a cheat, just a hope that due to the chaos and disruption of the pandemic, there may have been some compassion and relaxation of the normal constraints. I guess not.

There was but that concession was till end July and only for those who were stuck due to travel restrictions.

Visas are being processed from abroad and members have been getting approvals.
