job seekers allowance - residency application

Hi

My husband is currently in UK on a visitor visa.

I have recently finished university and don't have a job we felt that the application for residency would be more successful if we applied once I am employed.

I am currently job hunting but it is taking much longer than expected (5 weeks now), I would like to know if I claim job seekers allowance (which I have never done before so am unsure of regulations etc) until I get a job, and I don't make the application when I am claiming it, will it effect the application?

Just to clarify, I would be claiming JSA until I get a job, and then, once employed, would stop claiming JSA and would apply for the visa.

Any help would be great!!

You don't tell us anything about yourself. You are British? If not, what nationality?

And can you explain why your husband is in the UK on a visitor visa? Where is he from?

I'm british yes, my husband is Egyptian

He's here on a visitor visa to visit I guess, he's lucky enough to have his own business in Egypt that he can manage online so he was able to come here so we can be together while I wait until I get a job.

You are certainly entitled to claim whatever benefits you are entitled to. You should proceed to claim if you are entitled.

Do appreciate that your husband cannot apply for a spouse visa in the UK. He needs to return to Egypt to make the application there.

As regards the financial matters here, it "merely" needs to be clear that your husband will not need to claim certain Public Funds. Do the two of you have any savings? If so, roughly how much?

As regards your husband's business, are you saying that he would continue to operate that after he arrives in the UK on the spouse visa? If so, roughly how much profit (in Pounds sterling) does the business make per year?

now we don't have savings because my husband opened a new business in Egypt before we came to England. the business make about 15.000 pound every year . but do you think there is anyway for him to apply from here because really i dont want him to go Egypt and wait for the visa for long time.

If he is on a tourist visa, he cannot not apply in-country - he will need to return home and apply from there. Any application he makes whilst on a tourist visa will either be refused immediately, meaning you waste time and money, or the BIA will take a long time to decide it, and then it would probably be refused anyway, meaning he will become an overstayer.

The best and only option would be to return home and apply.

Two points, as already said, he needs to return to Egypt to make the spouse visa application. Secondly, are you saying that after he moves to the UK on a spouse visa his business will still make £15000 pa profit? If so, and proof of that can be shown, well, it appears to me that the financial test is probably passed.

That's a great help, I'm not sure what proof we can provide as in Egypt everything is dealt with in cash, and for the business he's in they don't do tax returns so nothing official...this is why initially we were thinking it would be better for me to return and get a job
