FLR Questions Regarding a Minor

So, my daughter and I are here on spousal and dependent visas thanks to my husband, but we need to apply for the FLR this Winter.

Here's the sticky situation.

I don't have sole custody of my daughter, it's joint as is the legal norm in Texas with divorced parents.

I have a letter from the father giving permission for her to move here in 2018 and I have the divorce decree which shows me as the primary parent with the ability to determine her residence

Here's the question:

Do I need a new letter from him? I'm unable to locate him, but, will obviously hire a private investigator/lawyer as necessary but I wondered if the original letter doesn't hold up as it granted permission and was signed and dated and notarized and all and I have the right to determine her location/residence.

This is not from any known UKVI ref or relatable experience only opinion. If after using PI still unable to locate him, use the previous documents as was used for the initial spouse visa application and include a cover letter and attach evidence of efforts to locate him and get a new letter. That you even had to use PI should make it clear that there was no contact and situation has not changed to warrant
