One Year Visit to UK for Taiwanese Spouse

Post by msparksr » Mon Sep 14, 2020 3:12 pm

I am a UK national living in Taiwan with my Taiwanese spouse and daughter who is a dual national. Since the school age in Taiwan is 6 (one year later than the UK), I am considering spending one year in the UK with my family and enrolling my daughter in a UK school for a year.
This would not be a permanent move - we have a property and business in Taiwan.
What options would my wife have for joining us? Up to 6 months would be easy (visa free), but for more than 6 months what options are available? Would leaving and then returning within a short time for a second visit be flagged by immigration. Is it possible to apply for a visa for a longer stay.

Spouse visa??

Not recommended. She cannot be spending more time in the UK than she does in Taiwan. Any visitor type visa only permits stays of up to 6 months.

On a visit visa, the applicant/visitor is expected to "not live in the UK for extended periods through frequent or successive visits, or make the UK their main home" (Section 4.2 of Appendix V, Immigration Rules).

If your wife were to come to the UK on a tourist visa, make sure she has excellent health insurance, as she will be charged 150% of cost if she were to use any NHS service.

As CR001 has advised, the correct approach would be for your wife to apply for a spouse visa.

But that would cost us upward of GBP2,500. Also, the rules for the spousal visa state: "You and your partner must intend to live together permanently in the UK after you apply". What would happen if we just left after one year and then decided to come back permanently in the future (possible after we retire)?
