Tier 2 GEN PBS Dependent for baby, born in UK

Post by KARTHIK18 » Fri Sep 25, 2020 2:10 pm

Hi All,

I am looking for some information about VISA for baby, born in UK.
I am Tier 2 General PBS Main applicant. my visa expiring on 15-Jan-2021 (i.e. in 4 months). I have 3 months old baby, born in UK. I have got baby UK birth certificate.

My queries are,
1- Do my baby need Tier 2 General PBS Dependent visa even when my visa is expiring in less than 6 months?

2 - If #1, Yes. Since my (parents) last visa type is 'more than 3 years' visa. So while applying, It is considering baby visa under category 'More than 3 years'. visa Fee = 1427 GBP + IHS = 200 GBP, Do I have option to select less than 3 year visa so that visa fee reduces? if Yes, How can i do this?

3.If #1,NO. I read in some portal as NHS services are chargeable with 150% if any consultation after 3 months of baby born when baby is not holding any visa/status. is this true?

4. Is visa fee refund possible in case of application withdrawn( i.e. in between after submitting VISA application in online and before attending biometric appointment)?

Could you please provide your inputs on above queries?
Thanks in advance.

Regards,

1. If not traveling, then I think it’s optional.

2. Baby’s leave may be granted in line with parents’ leave under 319I(a).

3. Seems true. An alternative is to get adequate health insurance cover for child?

4. Yes.

Children born in the UK to those here lawfully for more than 6 months

If you give birth to a child in the UK, your child will be entitled to free NHS hospital treatment in England on the same basis as someone who's ordinarily resident.

Your child is covered until 3 months of age, but only if they did not leave the UK during that period.

You'll also need to meet one of these criteria:

you have a valid visa of more than 6 months and paid the surcharge for that visa
you have a valid visa for more than 6 months, but were exempt from paying the surcharge
you have a valid visa for more than 6 months, which you applied for prior to 6 April 2015

You should apply for a visa for your child during the 3-month period after your child's birth.

If required, you may have to pay the surcharge for your child. Failure to do so means you may be charged for NHS services provided for your child after the 3-month period.

If you need NHS hospital treatment, you will be charged at 150% of the national NHS rate if you are a national of a country outside of the EU, Norway, Iceland, Liechtenstein and Switzerland.
