Tier 2 dependent visa

Post by Eli ng » Sun Sep 27, 2020 2:32 pm

Hi all, I would like to inquire some information regarding the application of a tier 2 dependent visa. My girlfriend if 7 year is currently working in UK with a tier 2 (general ) visa as a pharmacist for xxxxxx. I am applying from Kuala Lumpur ,Malaysia.

I have applied for a tier 2 dependent visa.
I have applied using this link (https://visas-immigration.service.gov.u ... /dependant )
as a partner. I have gone through most of the process and paid my IHS and is about to upload my documents I noticed I have to submit a form call appendix 2 (VAF 4A). The document mentioned that it is intended for application for people that is applying for dependent visa where the sponsor/partner has "settled" in the UK.

My question is where the wording "settled" mean having a valid IRL or just means that she working with a valid tier 2 visa.

Best regards ,
Eli ng

This is not relevant to a tier 2 dependent visa.

Settled = ILR

How long has you girlfriend been working in the UK?

As an unmarried partner, you require evidence of living together for at least 2 years.

Thank you for the reply. My girlfriend has been working in the UK for 3/4 years. So is almost able to apply for ilr.

So you don't have any evidence of living together in a relationship akin to marriage for the last two years??

Point 71 in the PBS Dependent Guidance states this very clearly if you are an unmarried partner.

https://assets.publishing.service.gov.u ... 8-2020.pdf
71. Where you are applying as the durable partner of a Main Applicant but are not married or in a civil partnership with them you will need to provide documents to show that you have been living in a relationship akin to marriage/civil partnership for a period of at least two years – documents should therefore cover the whole of this period. Documents will only be accepted where they are from official sources such as utility bills or NHS registration

I have bank statements with the same address from past 2 year while I was studying in UK and we lived together
before I have to fly back after I finished my studies in uk. I also have other evidence like postcard, pictures , Christmas card from friend and Facebook message for the past 7 years .

I have another question regarding the tier 2 health and care visa. As I mentioned that my girlfriend is working as a pharmacist but she is currently holding a tier 2 general working visa .
She is qualified for the tier 2 health and care visa (H&C)however she just renewed her visa last September before the H&C was implemented. So she was not able to switch to tier 2 H&C at this moment.

I would like to as if point 11 in the SWS dependent guildline applied to me this context ?

Lastly I would like to thank you for taking your time in helping me with all this question.

You need much more than just your own bank statement. UKVI will expect to see things like tenancy agreements, utility bills, council tax, HMRC letters, NHS letters etc in joint names or addresses to each of you individually.

When did you leave the UK??

You have to apply for the same visa category that she has, tier 2 general normal visa.
