Tier 2 - essential travel while waiting for decision

Hello

I applied for my General Tier 2 extension with a UK university sponsor on 26 August 2020. I was eligible for providing biometrics by the UKVCAS app through my phone. I am still waiting for a decision.

My current BRP is valid until 9 October 2020. I had to travel to Istanbul to attend a hearing of mine because I am divorcing at the moment which is on 8 October 2020, I will travel back to UK on the same date before the BRP expires. At the moment I am in Turkey and away from UK.

Now I have seen these paragraphs from UKVI website on General tier 2 extension:

"You must not travel outside of the UK, Ireland, the Channel Islands or the Isle of Man until you get a decision. Your application will be withdrawn if you do."

I was not aware of this.

I think I can enter to UK without problems on 8 October but if my application will be withdrawn I will not be able to apply before my BRP expires!

Do they regard these kind of essential travels as exceptions? Because I had to attend the hearing.

One other option can be now for me to go back to UK immediately and make a new application!

If anyone can please advise about the matter, it will be much appreciated.

It depends if the decision has been taken for your application or not. If decision is already taken, it won't be affected by a travel abroad. If the decision is not taken yet, the travel abroad would cancel the application. But you don't know it until it happens because you don't know if your application has been determined or not. That's why many recommend not to travel when you have an immigration application pending.
