American marrying Irish citizen

Post by rachelr7 » Mon Sep 08, 2008 5:50 pm

Hi all,
I'm newly engaged and hoping to get some questions answered. I am American but have lived in the Netherlands for the past year. My partner and I plan to get married by the start of the summer (I'm a teacher and need to wait until the school year is over). I am going to join him in Ireland, once this all happens. What are the steps that need to be taken in order to get married and be able to live and work legally. I've read some things about an EU1 stamp or visa, if I've lived in an EU country (which I currently have residence) or a Stamp 4? Ideally, we'd like to have everything set and ready to go so that I can potentially start working asap.
Thanks for all of your help!
Rachel

Where are you planning to marry?

If in Ireland, have a look at the following site.

http://www.groireland.ie/getting_married.htm

Now, if you marry in Ireland, you would enter on the 90 day visa waiver, marry, then apply for the Stamp 4 from within Ireland once you are married. Keep in mind that if you plan to marry in Ireland, it is a lengthy process, and once you come to Ireland, the marriage will have to take place within that initial 90 day period, so it will take some planning ahead as far as filing the notice with the registrar and so on. If you marry elsewhere, you can apply for the Stamp 4 straight away after entering Ireland. There's no way to apply for it from abroad. If you are wanting to start work right away, it might be easier to marry elsewhere and enter Ireland as a spouse so you can apply for the Stamp 4 immediately.

The EU1 would only apply if your partner were living with you in the Netherlands and exercising an economic Treaty right, such as working, and then moved back to Ireland at the same time as you.

Well I am anticipating getting married in Ireland, but I guess if it's easier somewhere else, we can do that also. I've read that you have to register 3 months before you want to get married...does that mean that I have to be living there at the time? or can we register 3 months before I plan on move/marry? As for the stamp 4...I can apply for that once we have our marriage certificate. Would you say that it's pretty much guaranteed or is there some sort of requirements/process involved in that? How long does that take to get?
Thanks for your help! I can use as much as I can get :)
