Appointment confusion non-visa req’d stamp 4

Hi there,

I see this forum has been very helpful and perhaps someone can assist me.

My husband and I are married 6 weeks. He is Uruguayan and I am Irish. He is currently in the country on a 90 day visa (holiday visa). We were advised to attend a registration office to submit our marriage certificate and get a stamp 4. When we go for an appointment unfortunately it says they’re only accepting new registrations. My husband had previously been in the country on a Stamp 2, this was before we married and went on honeymoon.

I’m completely unsure what to do as the advice is still on the website to attend for an appointment. The Burgh Quay office is not replying to email.

If your spouse or civil partner is living in Dublin, they must make an online appointment with INIS. You should also attend the appointment with your non-EEA spouse or non-EEA civil partner. You can book the appointment before coming to Ireland

When your husband arrived at the border, what did he tell to the officer at the border? Did he say he came here to get married or to join his Irish spouse? He would need that in order to get registered.

If he said he was here to 'visit' some place or someone, that is not sufficient for the purpose of long-stay registration.

Assuming he has told the officer everything accurately, the next question is, where do you live? Do you live in Dublin or elsewhere? Only Dublin residents can use online renewal. So if you live elsewhere, chances are that the officer is asking you to submit a formal application to SOIN unit, which is going to take 6-12 months.

Assuming that you live in Dublin, the final question is, when did his student permission expire? If his permission expired after 20 March 2020, or maybe just a short period before this date, he should be able to use the online renewal system to apply for Stamp 4 directly. If his status expired long time ago, you should send an email to Burgh Quay office asking for next steps. The email address is burghquayregoffice@justice.ie. You need to provide his GNIB/IRP number and the expiry date in the email. The GNIB/IRP number is usually recorded in the top corner of the last page of the passport.

INIS is getting more and more strict on people who had a student permission (Stamp 2) and got married with an Irish/EU national when their permission expired. They may ask such people to submit a formal application to SOIN unit to be examined before they issue a Stamp 4 permission.

Thank you so much for the reply. We both live in Dublin.

He told the officer that we were married and produced our marriage certificate. We were then told to email GNIB in Dublin to make an appointment to come in and get the stamp. Unfortunately GNIB are unresponsive.

My confusion now is that he’s officially not on a stamp 2 (stamp 2 expired in April 2020), he’s on a landing visa 90-day. Therefore he actually doesn’t have anything to renew and anyhow Burgh quay are only accepting new registrant appointments through their system. It’s also impossible to get one so it seems.

I’m really not sure what the next steps are here.

He's non visa required yet you think he's on a holiday visa?

His stamp is still valid, therefore he should use the online renewal as was told.
