Divorce after got EEA ILR

Post by sorindex » Mon Oct 19, 2020 2:45 pm

Hi,

I am from Argentina and got married there with my Spanish wife. Living here in UK for 6yrs and got my ILR (EEA settled status) already. Turns out we gonna get divorced. Do I need to inform HO about it? I do need to reapply for the ILR?

Thanks in advance

Absolutely not. Your divorce has no effect on your ILR at all. You are settled in the UK as per UK immigration rules and granted ILR. That is the end of the road for any immigration dependence on your spouse. ILR when granted never lapses (unless you leave the UK for more than 2 years) and your relationship with your spouse has no effect on it anymore

Thanks for the quick response. I just saw somewhere on Gov website asking to inform about Marriage Breakdown if my visa was based on relationship, which I believe it only applies to my case if I was not with ILR, only with the pre-settled status right?

EDIT: You pretty much respond that after replying, so feel free to delete this message 🙂.
