I'm no lawyer, but I'm not sure he has broken any laws. Luckily for him the VWP form doesn't include a question on previous overstays, so unless he was specifically asked at the POE he didn't commit misrepresentation (which indeed results in a lifetime ban).sakura wrote:I'd advise you not to even risk stepping foot in the US - he has broken the law twice and seems to think it is possible to return? I am no expert but I think that the fact he used the VWP and/or re-entered even after overstaying more than one year might well constitute a lifetime ban, if the US authorities in the UK or US ever find out. I would seek professional legal advice before going to the US embassy.
But the fact that his initial overstay not only makes him ineligible for the VWP, but also bars him from re-entry for 3-10 years, means that it is some form of misrepresentation, no?
