Tier 2 Dependent - Visa extension with Spouse eligible for ILR

Hi All

I would request your inputs on my situation.

My wife is a Tier 2 General visa holder and will be completing her 5 years (for ILR eligibility) on Jan 17, 2021. She will be applying for ILR in early Jan 2021.

I joined her in the UK 2 years ago and therefore, my current visa expires on Jan 17, 2021 and would need a visa extension shortly to continue to stay with my wife.

My question is what should be the sequence of application for us:

1. Should we file concurrent applications (she files ILR application and I file Tier 2 extension) or she has to successfully complete her ILR application first before I could start my Tier 2 extension application (in which case my current visa would expire before she gets her ILR).

2. Do I need to change my visa status - if yes, would not not mean that I lose all the time period I previously accrued on my Tier 2 dependent visa.

Any advice will be much appreciated.

1. Either but you must apply before your current visa expires.

2. No need to change visa status. Simply apply for a tier 2 dependent extension.

Just to clarify what you meant by "Either but you must apply before your current visa expires."

Both me and my wife need to file our respective applications (Tier 2 extension and ILR) parallelly ands separately before our visa expires. And the Home Office will consider the 2 applications in tandem since both of them are linked?

Your application will only be considered once your wife's ilr has been considered. If he told fails, your application will also fail. You can't get an extension if she doesn't get ilr.
