Tier 2 General visa-Child

Hello All,

I have got ILR earlier this year through Tier 2 General visa 5 years route and my wife (Tier 2 Dependent) has got her ILR last month. Now I need to extend my chid's visa now which expires next month, I am not sure under which category I should apply for extension?

Tier 2 General dependent visa? Or ILR dependent? Or I can apply for ILR straightaway for my child?

My child was born in India and he is 2 years and 9 months old now

I would be grateful for your guidance

Many thanks for your reply. My child has only completed 2 years and 4 four months on Tier 2 dependent visa and he was born in India, can I still apply for ILR for him?

Ther is no min 5 year residence requirment for children. You could have included the child with your spouse's ILR application. It would have been the simplest way to do it

Thank you for your kind reply, I was not aware of this when I applied for my wife. I was told to extend visa for him

Can I still apply ILR separately for my child?

Could you also tell me which form I should use for him. Is there any separate form for children?

Yes you can apply.

Set O or Set F.

It was my solicitor who advised me to extend my child's visa when I applied for my ILR earlier this year.

I think he meant that after obtaining ILR I will qualify for citizenship in 12 months, so that I can apply for naturalisation for him just by extending his visa for one more year.

He is wrong.

Children born abroad required ILR before they can be registered as British when eithe parent is also applying or is already British and the other parent holds ilr.

Hi CR001 and Vinny,

I just need a final clarification regarding my child's (2years and 9 months old) ILR application form.

As myself (Via 5years Tier2 General Route) and my wife has got ILR already, Can I still use Set(O) form separately for him (OR) do I have to use only Set(F) form.
