Regarding the effect on ILR when working from a foreign country

Post by kishoremvrs » Mon Nov 30, 2020 6:59 pm

Hi Team,
I am on a Tier-2 General visa working for a British company. I am from India.
I have my engagement in Jan 2021 and marriage in May 2021 and i have to travel to India for these events.
Based on the current covid situations, we have to serve 2 weeks home quarantine before we can start going out. So i would like to work from India for the first 2 weeks and then want to be on leave. But whatever it is i will make sure i am not crossing the 180 days Absence limit in a rolling year.

So i would like to check, in this case should i need a letter from my company for this absence period when i apply for ILR(I will complete 5 years in 2023)? or can i state the reason without the companies letter?

Thanks in advance.

For ilr based on Tier 2 an employer letter for absence is mandatory.

Thanks for the quick response CR001. I can get the employee letter for whatever days i have been on leave. But for the days i am working from India also do i need to get the letter from Employer? If so what should it state? should it say something like granted permission to work from India for so and so reason?

It is not about wfh abroad. It is al about absence from the UK, it all counts towards your limit.

I understand that we need to provide a letter for all absences. But the marriage thing is my personal reason. My company is not objecting me to work from India but they cannot give a reason because i am not on a business travel for the times i work from India and also my company doesn't have a branch in India to manage that way as well.
Do you have any suggestions in this case? Thank you so much once again.

They simply need to state absence of X days with permission.
