ILR application with dependants

Hello everyone,

I would like to ask for some help regarding my upcoming application for ILR. Currently, I am on Tier 2 General Visa and will be applying for ILR this coming January. My husband is also with me here in UK and he have a dependent visa, when I apply for ILR, what visa does my husband need to apply? Is it just an extension of dependent visa or he needs to switch to spouse visa?

How are you applying ILR? Tier 2 route or Long Residence?

How long your husband has been in UK?

Sorry to bother you all but can I ask another question.

My son was born here in the UK last 2019, when I apply for ILR he can then apply to register for citizenship?

Is the correct?

Once your ILR is approved & receive BRP, then you can register your kid as BC via MN1 form.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Your husband will apply for a PBS dependent extension. He can apply for ILR when he completes 5 years minus 28 days from initial visa issue date.
Obviously his application will be successful if your ILR is successful first.

Thank you for all your responses.

Does my husband still need to pay the health surcharge if I am a healthcare worker?

As I have read that healthcare workers are exempted in paying the health surcharge including their dependants, but I am not sure whether it applies if I am applying under ILR?

As far as I know, he does not need to pay IHS in this case. Also, ILR does not have IHS anyways for yourself.

The extension for PBS dependent is pretty straightforward. Once you fill out the form, the checklist will tell you the documents needed. The documents will be quite basic ones and the same what you used previously.
