Hi guys
This is the first time I came across such a very helpful immigration forum

Actually I immigrated from Ghana to Ireland in 2018 on a student visa for master in accounting , after 1 year I got my stamp 1G visa, ever since I have been looking for an accounting job despite the fact I graduated with a good grade from Griffith college, I couldn’t find any critical skill job despite all my attempt at interview and job applications.

When I was in college I met my finance who’s German born and a Nigerian by anscentry whom at that time was working and earning above 40k annually. However things turned around bad for her when she couldn’t get a new job since 2019, she was getting partial jobs that she couldn’t hold unto as a result of discrimination. We been together and she been on social welfare and HAPP. She got a new job before covid for 60k and was more of travelling,they had to let her go and paid 2 months of her salary as a result of covid restrictions

Now we been living together through the hard times and she suggested that my inability for me getting a job is because of my stamp which many recruiters told me but I refused that I can do it on my own to get a stamp 4. We have all the proof such as pictures from my graduation, text messages, rental agreement name it

I’m currently on my last year of my visa stamp for 1G to expire 10th dec 2021. I currently work security and earn around 29k this year which we used to sustain. I don’t know what to do at this junction but she currently looking for jobs

I really do love her and we are thinking of marriage next year January.

My question now relates to

1. Can she sponsor me on a stamp 4 as she’s not working but I’m a resident and have been working
2. What other visa options is open to me, can I apply for stamp 1
3. Will I have to reapply for another school again to study to get a stamp 2 if I can’t find a job.
4. Once I’m done with a new course will I be granted 2 yers post study again or just 1 year

I am totally confused and need help, wanted to visit the lawyers also

If she was made redundant and actively seeking work, then you will be fine to apply, even if she is on welfare payment. Otherwise she will have to stop the benefits, and you get a medical insurance, for you to qualify.

Many thanks, yes she’s actively looking for a job and has the reduancy papers and last 2 month salary

But do we have to meet the 40k rule as set. I have a medical insurance I used for my renewal

There is not 40k requirement to be met if she is a German national in Ireland.

Okay but I went through the thread and I was reading of requirement of 40k or 36k for sponsorship and Eu sponsorship

I’m totallly confused
I can show I’m responsible and have paid taxes this year also and I am financially independent

You being financially independent will be irrelevant if you plan to apply for Stamp 4EUFAM based on de-facto cohabitation with a German national. There is no salary requirement for her to be on 40K either.

You will need to try very hard to convince INIS that your relationship is genuine, that you are living together, and that this is not a marriage (or cohabitation if you haven’t got married) of convenience since you are going to apply for a stamp change right when your student permission expires.

The issue of convincing the INIS is not an issue

She was there in my graduation in 2019
We lived in the same house from August 2019 but I was not on the rental agreement only her
We have pictures both on our Instagram from 2019 to 2020
We have call and text logs
Evidence of proof for new rental agreement this year February 2020
We have lands in Nigeria bought in her name and mine
We have joint account opened last week
Transfers from my account to her as rent and from hers to mine
Pictures with family & friends from 2019
Evidence of outing and trips
Me paying her insurance when she couldn’t afford it
Utility bills in our Joint name
Over 1000 euros spent on engagement ring since January 2019

Name it the list is endless

What I’m concerned is about people on social welfare can they sponsor. She has the contract of job she received and began to work this year and the salary paid into her account. If not covid, she was permanent.

I didn’t mean salary requirement, I meant financial requirement to have earned over 36 or 40k in the last three years, does it apply to her

As we have repeatedly said, the only thing you need to worry about is how to convince INIS. It’s much harder to present your evidence in writing, especially when your status is about to expire and she was on benefits before.

She has been exercising her Treaty Rights so she is an eligible sponsor. Her history of using benefits and financial threshold is not a problem.

Depending on your levels of written English, but I'd say you are fine. Hiring a solicitor does not increase your chance of getting approved. A solicitor can only organise your documents and fill the forms for you.
