Tier 2 Switching Employer (Skilled Visa)

Hello Folks!!!

Hope you all are doing fine with COVID running around.

I was trying to find any similar discussion but unfortunately didn't find anything (or may have missed) so apologies for cross-posting.

I have a query about changing employer. I am currently on Tier 2 General and I have received an offer from a different employer. The job category is the same and it is also in the shortage list. My questions are:
  • If I am going to switch the employer, that would be a Tier 2 to Tier 2 switch or it will be Tier 2 to Skilled Migrant switch?
  • My current T2 leave will expire on 12/2021 (including my dependents), what effect this would be on my application?
  • My dependents also have to apply for a switch or it is not necessary? Because I came across one thread here in which someone got curtailment letters from the Home Office.
  • On 12/2021, I will complete the 3 years period on T2 and my dependents will complete their 2 years period. The new visa would be issued for 3 years for me if I will apply now?
  • I have heard that transferring from T2 to Skilled restart the 5 years route, is this legit?
  • What would be the safest way of doing this while avoiding any curtailment and ending up paying extra fees etc.?
  • (This could be the silly question) Is there any way to transfer the existing sponsorship to the new employer to avoid paying again for the cost which I paid already for another year until 12/2021 for me and my dependent? In other words, how can I save the amount which I have already paid to home office?
Just to add: I am based in Scotland at the moment and the offer is from an employer in England.

I really appreciate the forum efforts and appreciate some guaidance please?

You will switch to Skilled Worker route

None, you will get a new visa that will expire at a later date as per your COS. Your dependents will apply for an extension when their current leave expires

Follow the guidance, there should be no curtailment and as long as you qualify under the new system and everything is fine there should not be a problem

Bundle of thanks Frontier Mole for your reply. I was waiting for some reply eagerly.
  • I came across one post (which I cannot find now), it says that the main applicant applied for a switch from T2 General to T2 General (new employer) and he inquired from the home office that whether the dependents have to reapply or not. They told him that they don't have to do this. However, after few weeks time the dependents received the curtailment letters saying that their main applicant has switched to a new employer and they are no more connected with him as his dependent; therefore, their current leave (which was valid) is no longer valid and now deemed curtail. He then applied responded back to them with the help of this forum and after 6 months of time they got the leave back with an apology. Therefore, I just wish to confirm that there is no such requirement that they have to apply with me now because what is the use of asking home office when they will do something similar? (Sorry for asking it again though :oops: )
  • Also, I qualify for Global Talent Visa, therefore should I go for that one of should I opt for the skill worker extension? Because in either the case I am left with 3 years for my ILR. Any suggestions please?

Does the Home Office have perfect processes and a faultless human error free system - no they don’t. Errors happen and the story of the curtailed of leave in error is not unique. It is very very rare given the vast numbers of applications they deal with.
Therefore the chances are very minimal that you would suffer the same but no one can give guarantees. IMHO you are almost certainly not going to experience the issue of dependent curtailment.

Global talent route - My experience is very limited and therefore it is better for others to comment
