Spouse visa extension urgent

Post by Highlyfavour » Wed Feb 03, 2021 11:09 pm

Hi! I am in need of your urgent advise. My spouse is due for extension in February 2021. My spouse earns 19,200 a year, the problem is on the September 2020 payslip the employer deducted unpaid sick leave, will it affect the application? The payslip showed the salary as £1603 then the deductions. Do home office calculate the financial requirements before all deductions?

Here is a breakdown
Sept salary before deduction- £1603 which is shown on payslip. After unpaid sick leave deducted my spouse received £950 net pay after deduction of tax, pension,N.I and unpaid sick leave
October salary £1603 before deduction
Nov salary £1603 before deduction
Dec salary- £1603 before deduction
Jan salary-£1603 before deduction
Feb salary -£1603 before deduction

Also after pension is deducted my partner taxable pay is £1549 will this be a issue when applying for extension? Thank you

The Home Office looks at the gross salary (before deductions), not the net salary (after deductions).

How long have you been employed? Unpaid leave doesn't count towards the financial requirement.

"Any period of unpaid maternity, paternity, adoption, parental or sick leave in the 12
months prior to the date of application will not be counted towards any period relating
to employment, or any period relating to income from employment, for which
Appendix FMSE provides"

As said it is gross income before deductions that is considered.

Why don't you apply under CAT B salaried and provide 12 months income to cover yourself?

I'm applying using FLRM form. If its before deduction then it probably be fine cause on the payslip it did show the salary £1603 then in the deduction section it shows whats being deducted.

If that's the case then it is fine.
