Switch to partner, over 18 dependent child

Post by Violetsareblue » Wed Feb 03, 2021 8:18 am

Hello there, I wanted to ask a few delicate question for future decision and I’d be glad if moderators could advice on this.
I got granted leave to remain as a parent(of one British) following an asylum refusal less than a year ago, along with all my kids(non British, nearly spent 7 years in the U.K.) as my dependent. My oldest child is now 19 but was granted leave as child under appendix fm when he was under 18.
I’m looking to switch to partner visa in a year time, so will I still be able to add my over 18 child in my variation of leave? He does not leave an independent life. He studies at university but still live at home during holidays and most weekend.
Will he still be considered as a dependent child if I switch from parent to partner?
Please also try and provide a reference because I haven’t been able to find anything online, apart from the ‘child guidance’ under appendix fm, but it wasn’t clear.
