DEPENDENT - ILR APPLICATION

Hello, It has been a long time since I last posted here. I would like to ask for some advise regarding application for ILR in particular dependents.

Back story: My PH passport will expire this October 2021. I hold a tier 2 (general) leave to remain visa which will expire May 2022. I will be meeting 5 year continuous stay requirement for ILR this coming May 2021. I understand that from then, I can apply for ILR after I pass the LITUK exam. I also have 2 sons. The eldest joined me here from the Philippines last July 2019. He will be 16 years old this October. The other one is a baby, born last June 2020. My partner and I are not married.

So my questions are:
1. How long before the passport expiry date can we apply for ILR? What i know is your passport has to be valid for at least 6mo when travelling. I am not sure if this is the same with ILR application. I am trying to book a slot for renewal however there isnt just any slots available yet.
2. Would the home office honor a passport which is very close to expiring but is stamped as extended by the embassy? I have been told that our embassy can issue an extension stamp if we need the passport for specific circumstances and we do not have enough time to renew.
3. for my 1st born, since I will be adding him as my dependent on my application, would it be more advantageous for us to apply for ILR before he turns 16 in October? he is studying full time and is living with me. Would there be a chance for him to be denied ILR if he is past 16yrs old upon lodging the application? Will i have to supply specific evidence then compared to if we apply before he is 16? if yes, what are those please?
4. For my baby, since he was born when I was still under the tier 2 visa, do i have to include him in my application as dependent?or can i just wait until I receive my ILR so I can immediately apply for his citizenship?

1. Your passport needs to be valid when you apply. There is no requirement it must be valid for X number of months.

2. You're overthinking.

3. Your overthinking. Just add him to your application regardless.

4. No need to include in application.
