Qualification for ILR under Tier 2 - offer withdrawn

Post by TheoB » Thu Apr 01, 2021 8:15 am

Hi all,

This is my situation:

1) I was employed by company X under Tier 2 sponsorship from Sept 2017
2) In April 2019, I received a job offer from company Y who handled my visa application and I received a new Tier 2 visa under their sponsorship starting July 2019
3) A few days before my start date with company Y, they withdrew my job offer due to failing background checks so I did not start working with them
4) I contacted company X who agreed to re-employ me and we went through RLMT and a new Tier 2 visa was issued under the sponsorship of company X for a role starting in Oct 2019
5) In the period of transition between company Y and X (3 months), I did not receive any curtailment letter or notice nor did I work for 3 months

Would this affect my eligibility for applying to the ILR when the qualifying period ends? Assuming all other eligibility criteria are met.

Thanks
