Spouse Visa Route - ILR Dependent or Tier 2 Dependent

Post by PraveenScience » Mon Apr 26, 2021 9:44 pm

Hi folks,

I recently posted this: New ILR Application - 6 months delayed and with all the inputs I have got, I applied for my ILR successfully giving the biometrics on last Friday. I am expecting a response by this week, as it is a Priority Service.

Since she hasn't completed her five years in the UK, I was in the thought that I cannot add her as a dependent in ILR. My questions are:
  • Should I have added her in the application when I am applying?
  • Should I apply a Tier 2 Dependent or ILR Dependent for her?
  • I haven't gotten a response for my current ILR application, but expecting this week. Should I apply for her now or after I get my decision for ILR?
  • When should I make an application for her? Both our current visas expire in less than 10 days.
Thanks for the guidance. Looking forward for suggestions.

Tier 2 Dependent
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Tier 2 Dependent
Thanks, this is helpful. So my original question: When I applied my ILR, I didn't add her as dependent. That's a correct thing I did right? :D

You can only add dependents to your ilr apllication who qualify for ilr at the same time as you do.

Okay great. Hey, my ILR Application has been Successful! I am so happy. So I should be using Tier 2 Dependent visa again? But I don't see that option. Plus I don't have a Tier 2 Visa now. It's ILR, is that okay?

Skilled worker dependent.

You now having ilr is irrelevant.
