Switch Spouse visa (5y route to 10y route)

Post by Abdulghanimelad » Fri May 07, 2021 12:11 pm

Hi everyone..

I hope you could advise me please
My wife and two daughters are British, I have been for 2 years on spouse visa and I should extend it in this coming November. However, I lost my work and still using my savings for family expenses. since I could not get another job yet to satisfy the financial requirement (payslips must start from this May), we decided to switch my visa to a 10 years rout.
My Question is: In case I got a job in the near future, can I be able to apply for return to the 5 year route.

Regards

If you are able to get a job before now and November, you can still apply under 5 years route under CAT B and in the event you dont meet the requirement for 5 years and you are granted under 10 years then you can switch anytime in future to 5 years route if you meet the requirement at that moment.

Thank you TODMATT,,

If I switched to 10 years route visa. Will the 2 years I spent on 5 years rout be still into account when I go back to 5 years rout, so there will be only 2.5 years left to be granted a PR.

Kind regards

Your clock will reset if you intend to switch to 5 years route in future which means you have to spend 5 years again to qualify for ILR however if you intend to stay on 10 years route then you must complete 10 years lawful resident in the UK and qualify under SET LR. I would recommend you to avoid being put on 10 years route because it is expensive.
