Applying for a spouse visa in UK - help with question

Post by Birky » Thu May 06, 2021 8:57 pm

Hello,

I am filling out a spouse visa application from the uk (i have been here on a fiance visa and just got married)

This question has confused me a little:

Is your current entry clearance or leave to remain as the partner of one of the following?
a British citizen
a person settled in the UK
a person with refugee leave or a person with humanitarian protection in the UK
a person with pre-settled status under the EUSS in the UK
a person who has leave as a Turkish ECAA worker or business person in the UK

My current entry clearance is a fiance visa - do i say yes because we are partners now, or say no because i came here with the intention of being partners?

any advice is grateful thanks!

The answer is YES.

Spouse Visa and Partners Children

Post by Birky » Mon May 24, 2021 7:23 pm

Hello, I am applying for a spouse visa from within the UK (I am currently on a fiance visa in the uk.) I am confused with what to put on the application for a certain question regarding my partners children. Due to him being divorced and having two children already. It is asking about non applying children for my partner (the sponsor)

Do i need to put this as yes, because althought i can fill in the details about his children it starts getting confusing and asking about parental responsibility and asking for his exwifes house details and the level of contact or things like adoption certificates and lots of information i just dont know. It doesnt even give the options for his kids living at his their mums house and i just dont know what to go with that question

Can i just say no and fill in the fact his has two children he pays maintenance for in the next section (like it was on the fiance application.)

Its asking for lots of details about his ex wifes utility bills and birth certificates that she has and im not sure i can get hold of them?

Answer what you know and address other unknowns in a cover letter to HO which you then upload.
