I am a non-EEA national, on a five-year Residence Card and currently going through a divorce with a Portuguese national. I am aware since we have not been married for more that three years divorce will autometically invalidate my Visa.
There is a child in the marriage and I understand that under Rule 248A 'Right of access to a child in the UK' I can apply for a visa to remain and have access to my under 18 child.
Now, I would like to know how does one make an application under Rule 248A?
I desperately need to know prior to the finalisation of divorce which will be in less that three months.

sorry to hear about your situation.
for access to child visa you neeed following
1.most importtant contact order from uk court(or statment from are partner(affidiviat)...my understaing is your partner is british...your child as well?plz explain)
2.proof of accomodation and maintance..payslips and rental agreemnet.
most importnat you are having contact with your child(any proops...letter from contact centre....or your wife letter

My wife is Portuguese and my our child was born in this country but holds a Portuguese passport.
