ILR 5YR ROUTE - Covid Not Meeting Financial Req

Hi everyone,

My husbands Visa expires 28th Nov we are within the last 6 months of him applying but we do not meet the financial requirement as I (sponsor) lost my job back in Oct 2020 due to covid and prior to that I was on maternity leave. Is there anyway we would save our 5yr route or will we be put onto the 10year route?

My husband is currently looking for a second job but we wont have 6 months payslips. I cannot work as I have a 1 year old.

If anyone could assist.

Are you stil on maternity leave? Do you meet the financial requirememt?

No my maternity leave ended august 2020 was on furlough for sept 2020 and oct 2020 then was made redundant, ive been looking for a job to fit in with my 1 year old but havent been lucky.

My husbands earnings do not meet the 18600 threshold unfortunately.

Can someone pleeeeease help?? Im not sure if the concession will apply in our case and really do not want to change to 10yr route :(

You will need to write a well detailed cover letter and explain the loss of income you have had a result of COVID-19. I have seen people approved under the 5 years route for explaining to the caseworker that they had a loss of income but if you can show that income was met prior before you went on maternity and also explain your husband situation, hopefully the caseworker will consider your application under the 5 years route. Good luck

Thank you for your help TODMATT.

I was on maternity pay just before i lost my job and my husband was on furlough.

If we add up what we earned within those 6 months it wont add to 18600 as furlough was 80% (if im not wrong) but going forward relying on the below statement does that mean we can use his normal wage and not what he got for furlough? his usual wage was around £893 and furlough is £725.

"an applicant or sponsor furloughed under the Government’s Coronavirus Job Retention Scheme will be deemed as earning 100% of their salary"

Thanks you so much for your help. Youve given me some hope in staying on the 5 yr route hope we can make it work!

Income earned during furlough count as normal pay you would received

"• a temporary loss of employment income between 1 March and 31 May 2021
due to COVID-19, will be disregarded provided the minimum income
requirement was met for at least 6 months immediately prior to the date the
income was lost - this is for a loss of employment income between 1 March
2020 to 31 May 2021 due to COVID-19 an applicant or sponsor furloughed
under the Government’s Coronavirus Job Retention Scheme will be deemed
as earning 100% of their salary
