Any information welcom

Post by Angela_za » Tue Oct 14, 2008 9:51 am

My husband is a British citizen, I am South African as are my 3 children. The 2 eldest being from my first marriage. We applied in April for settlement visa's for myself and the children. I received mine as did the younger children. My 18 year old daughter who at the time had just finished school had her visa refused, on the grounds that she was 18 and still had family in South Africa. She was granted leave to appeal, which we did using an Immigration Consultant. We were notified on the 25th September by the consultant that the HO had withdrawn their refusal and would now issue the visa and a letter was sent to me along with a copy of the Tribunals Service notification of the decision. After numerous visits etc to the High Commission in Pretoria it was revealed that they had again changed their minds and withdrawn their withdrawal of the decision and now would not issue the visa but had forwarded everything on to the AIT in London for a hearing date and had requested that the appeal be reinstated.

She is now in South Africa with my financial support with my elderly parents. She has never lived outside the family home, or been able to support herself in anyway.

Any ideas on what I can do?

When does she turn 19? What is she currently doing (e.g. university)?

Did they give any reason for changing their decision? It's strange that they tell you to come for the visa and then decide not to give it to you.

She will turn 19 in December, this appeal process has been going on since April/May. She is currently studying make up art, holistic Spammy Spammer and spa treatments.

They gave no reason for changing their decision at all. It is very strange, but I have the letter from the Tribunal stating that the original decision had been withdrawn and that they were satisfied that the appeal was complete. It was only about 3 weeks later that we found out they had again reversed their decision.

And we only found out that they had changed their decision yet again when we contacted them to find out if my daughter could go to the High Commission with her passport to collect the visa. They had not informed her, the consultant we are using or ourselves of their change of heart. Needless to say my daughter, who I have not seen in nearly 6 months is totally devastated that her wait continues.

Have just found out that the High Commission in Pretoria say that they made a clerical error in withdrawing the original refusal. Surely if they notified us of the fact that they had withdrawn the refusal and would now issue the visa they would indeed be forced or obliged to issue said visa.
