T2G status and ILR application after sponsor company Acquisition

Post by arvind3010 » Sun Aug 08, 2021 11:06 pm

Hi All,

I am working for a mid size firm in London which has sponsored my T2G visa since Nov 2016. My current permit is valid until Feb-22.

The company I am working for has been fully acquired by a Europe based company and this company currently do not have a valid UK sponsoring license. I have been told that only ownership has moved to the new company but my company as a legal trading entity will still remain.

I am eligible for my ILR in less than 3 months (October 30). I would be really grateful if anyone can advice me on the questions below.

1. Will the new company need to get a UK sponsoring license and transfer my CoS into their license ?

2. Can I make the ILR application based on current sponsoring company as its only 3 months away?

3. Can the current sponsoring company surrender its license, get a new license and re- sponsor me ?

4. Any other options for me in case 1 is not possible ?

There are many UK companies that have been acquired by foreign owners, e.g. some well known football clubs. If, as you say, only the ownership changed and the company continues trading in the UK without any change in their legal structure, then their sponsor licence, your immigration status and your eligibility for ILR will not be affected.
