Tier 2 to dependent visa help!

Post by tektintoff » Tue Aug 10, 2021 4:20 pm

Hi everyone, I'm in a bit of a unique situation. I'm Australian, as is my partner, and we're currently working in the UK on a Tier 2 General Visa. Now I'm looking to quit my job that's sponsoring my visa, but I figure this will be okay, as I can then apply to be a dependent to my partner's visa, is that right?

Also, when looking to complete the form from UKGov website, it says I'm unable to apply for the new visa while I'm still in the UK. I'm unable to go back to my home country (Australia isn't letting anyone in due to Covid), so is there any avenue for me to apply for the new visa while in the UK still?

Nothing unique at all.

Yes, if your partner holds their own Tier 2 General visa, then yes you can switch to a dependent visa.

Where does it say exactly that you cannot apply within the UK??

It depends. As an unmarried partner you must meet all the provisions of paragraphs SW 29.2 to SW 29.4 of Appendix Skilled Worker:

You are not applying for a new visa, but extending your stay in this category. It sounds like you are looking at the wrong application.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
