Tier 2 redundant- ILR implications

Post by Cyp20 » Sat Aug 14, 2021 3:15 am

Hello! I hope you can help with the following:
I have been in the UK for 4.5 years under Tier 2 general. My visa is valid until January 2022. However, I was made redundant and my last day with my employer was 27 July so I am waiting for the curtailment letter. I would appreciate your help with the following:
1. Have I lost the possibility of applying for indefinite leave to remain? I complete 5 years in January 2022.
2. I am about to get a new certificate of sponsorship which I will use for a new application. I have my wife and my kid as dependens, do they need to apply as well with me?

I am in a very difficult situation as I feel like I was so close to complete my time and now I feel I have lost everything.

I would really appreciate any comments.

1. No, provided you get a new sponsor and visa.

Thank you so much for your reply.

It means that even if I receive the curtailment letter and apply for a visa during those 60 days, it will not affect my chance to apply for ILR? Would my application be considered as a fresh and new application or as a change of employment application?

Regarding my dependents and if they need to apply for a new visa at the same time than me, can anyone share any light, please? I have been looking other related posts and the guidance pointed in those has been withdrawn by Home Office.

No issue on continuity. It would be a change of employment application.
