PBS dependant extension for 3yrs 3 month when main applicant has ILR

Post by Shamprasath » Mon Aug 16, 2021 11:40 pm

Hi All ,
I have got ILR on April 2021, my wife entered UK on December 2019 with PBS dependant visa valid till October 2021 so she have 3 year 3 month more to qualify for ILR.
I need to know how many years visa they will get in order to enter dates to pay for IHS surcharge ?
Will it be 3 years now and apply again with same cos ( during October 2024 ) for another 1 year to complete qualifying period for ILR.

Please guide me.

Also can anyone point to the guidance details or section which contain this information about number of years extension granted for PBS dependant of ILR main applicants in my situation.

Thanks in advance.

@CR001 : Thank you for the response.
Now i apply for 3 years with the COS letter.
Could you or any one clarify for the below scenario please...

DETAILS :
Tier 2 Dependant VISA Time frame : (Applied when i was in tier 2 visa)
1. 25/12/2019 to 01/10/2021 = 1 year 9 Month

I got my ILR on April 2021.
---> Now if extend her visa for 3 year with last COS letter, then it will be
2. 01/10/2021 to 01/10/2024 = 3 year

At this stage in total she will cover = > 4year + 9 month
Remaining 3 month left

My questions is how the last 3 MONTH will be covered ????

Option 1 : Do i need to use the same last COS letter to extend at that stage ( in Oct 2024 ) to cover the 3 month ??
OR
Please provide your suggestion for this scenario

Thank you in advance

You do NOT need a CoS letter for a dependent visa. The 3 years is stated in the immigration rules if the main tier 2 visa holder has obtained ILR.
Option 1 : Do i need to use the same last COS letter to extend at that stage ( in Oct 2024 ) to cover the 3 month ??
Again, you do not need a CoS from your employer to apply for a dependent extension. Simply apply as now as close to her visa expiry date as possible, schedule the biometric appointment a few weeks later. Apply using standard service. The date of the new visa will be from date of decision and will probably make up for the 3 months.
