covid exemption for tier 2 dependent visa

covid exemption for tier 2 dependent visa

Hello
If anyone can urgently reply, i would be obliged. I am on TIER 2 DEPENDENT VISA atm.
I have my ILR due in 1.5 year. However, i have been stuck in Pakistan because my father in law and uncle died due to covid and after that I became covid positive. Also, My mother was hospitilized because of covid. my 180 days outside UK will finish on 27th of August and i have to be in UK on that day but because of hotel quarantine(massively expensive) I want to come to UK after 29th when hopefully Pakistan will be in Amber list.( which will be announced on 26th and come into effect on 29th)
my question is when i apply for ILR after 1.5 years, can I get exemption for over staying on compassionate grounds because 2 deaths in my family as well as the contacting covid and my mother's serious illness? or I should play it safe and travel on 27th of August? I have their death certificates as well as all the reports of me and my mother. Has anyone been in the same boat?

When was your most recent Tier 2 dependent granted/issued? Exact date.

it was issued on 13/10/2020
valid till 13/2023

There have been no exceptions on the absence limits as far as I am aware. She can obviously extend her visa as many times as she chooses in order to qualify for ILR.

I came across immigration rules on gov.uk which got updated on 21 JULY 2021 which states as following:


Absences from the UK,

CR 2.1. To meet the continuous residence requirement the applicant must not have been outside the UK for more than 180 days in any 12-month period (unless CR 2.2. applies).

CR 2.2. For any absences from the UK with permission granted under the rules in place before 11 January 2018, the applicant must not have been outside the UK for more than 180 days during any consecutive 12-month period, ending on the same date of the year as the date of the application for settlement.

CR 2.3. When calculating the 180 days in CR 2.1. or CR 2.2. any period spent outside the UK will not count towards the 180-day limit if the absence was for any of the following reasons:
(a) the applicant was assisting with a national or international humanitarian or environmental crisis overseas, providing if on a sponsored route their sponsor agreed to the absence for that purpose; or
b) travel disruption due to natural disaster, military conflict or pandemic; or
(c) compelling and compassionate personal circumstances, such as the life-threatening illness of the applicant, or life-threatening illness or death of a close family member

Do you this applies to my case?
