Help on correct application - SET O or FLR M

Hi all - My Spouse and Child are on Tier 2 ICT dependent visa which is expiring next month. I am confused which application to select for Spouse and Child?

1. Myself - ILR via 10-year route (Previously ICT Established staff from 2010). Got my ILR in Jan 2021.

2. Spouse - On Tier 2 ICT dependant visa since Jan 2011. Dependent visa is expiring next month (Oct 2021). There is a 12 months break (May 2013 to May 2014) in her 10 years in UK as she went to India during the birth of child. Continuous stay in UK since May 2014. Can you please advise whether she can apply for SET O or FLR M?

3. Child born outside UK (India) - On Tier 2 ICT dependant visa since May 2014. Dependent visa is expiring next month (Oct 2021). Came to UK in May 2014 (7 years back). Continuous stay in UK since May 2014. Is the application process exactly the same as the spouse?

2. She only has the option of applying for FLR M spouse visa meeting the financial and English requirements. Her 5 year ILR clock will reset to zero.

She doesn't qualify for ILR on form Set O as you got ILR through long residence.

You can use the same application form as it allows you to add a dependent child in the application form.
