Hi firstly please don't shout at me if I am on the wrong page.
I have been married to my Nigerian wife for 2 years now and we have a 12 month old son. I am a British citizen and my son who was born in Nigeria is also now a British citizen. For the last year I have been unable to work due to a back injury. I am in receipt of Universal Credit which is £411 a month as well as £235 for the child element. Also I recieve £85 a month child benefit. This is topped up with £550 a month to pay for rent.
I am awaiting to see if I will be awarded pip. If I am awarded the lower level of daily living which is £60 a week and the lower level of £23 mobility allowance per week. Can I apply for a spouse visa. I have read that I need a disposable income after rent that compares to the equivalent of a couple living together receiving Universal credit, which amounts to £590 a month. Am I correct in calculating the 411 I get and adding the 330 monthly award from pip. Total £741 would take me above the £590 and should satisfy the clearance officer on the financial aspect? Or am I misunderstanding something. Please advise.

Hi,

Its for the equivalent family on income support

so A (INCOME) - (HOUSING COSTS, RENT COUNCIL TAX) > C( INCOME SUPPORT FOR FAMILY OF YOUR SIZE)
Income = calculate weekly amounts for everything


get the weekly amount - monthly amount * 12 = 1 year / 52 = weekly

Universal Credit £149
Child Benefit £19.6
PIP £60
Rent benefit £127
Total Weekly income = 355.6


A (income) - B (housing) >= C (income support for equivalent family, regardless of nationality)


C = Couple rates, children - £345.6
Income Support £117.40
Each Dependant child £68.6
Family premium £17.65
Disability premium £50.05
Enhanced Disability premium £24.60
Severe Disability premium £67.30
£345.6

A (£355.6) - B( Rent, council tax costs, which you haven't included) > £345.6


Also I'm unsure whether they include the disability premiums, because they do give them to people on income support, so if you get pip you're likely to include, unsure though ask some immigration solicitor. Find out about disability premiums from competent solicitor and also share with us here, I'm a normal person, but if you read gov appendix adequate maintenance guidance it says all this there.

Also you can use savings so for universal credit £6,000 no problem, between £6000- 16,000 they will deduct money from universal credit, pip no problem.

£6,000 savings / 130 weeks extension visa or 143 first entry clearance
£6,000 / 130 = £46, which can be added to income, you could use more, but universal credit will deduct, best things, is - your rent and council tax you pay, from A income and it should be more than £345.6 obv benefits rise each year this is for current year till next march 2022. ask someone about disability premiums and use savings if need be to make the shortfall.
