UK Spouse visa extension outside the UK

UK Spouse visa extension outside the UK

My wife came to the UK in 2018 after getting the UK spouse Visa but I had to leave the UK to the EU as a Cross Border contract worker in 2020. Due to the Covid it was difficult to travel daily, hence, my wife joined me in Belgium. But officially and tax purposes i maintained my status as a UK Cross border status. She had her the EU tourist visa and our baby (British citizen) was born in Belgium November 2020. Because we live in the EU, we applied for EU visa extension and it took some time. But now when we get her EU visa sorted, her the UK visa has been expired and need to apply for an extension. We pay tax in the UK and we have our home in the UK.

Now the questions are
1. Can she apply for UK spouse visa extension?
2. In which country uk Visa office she needs to apply e.g. in Belgium or we need to send the passports to home office?

She can only apply for a FLR(M) extension within the UK.

when did her spouse visa expire?

If you have been unable to travel back to the UK due to coronavirus travel restrictions and your leave expired between 1 March 2020 and 19 July 2021, a short break of up to 6 months in continuous residence will be overlooked and you will face no future adverse immigration consequences as a result. However, you are expected to make your next application as soon as possible on return. Those who have returned to the UK and did not make a valid application to stay upon re-entry, are expected to make arrangements to leave.

The application is online but both of you must be in the UK (immigration rule R-LTRP.1.1(a))

Thank you. The visa was expired on 8th of August 2021. I understand the spouse visa extension has to be applied within the UK, but we couldnt due to her Spanish Visa was processing that time.

If you both plan on returning to the UK, she will likely have to start again from scratch with a new 5 year route spouse visa.
