Can I bring me second wife into UK

Hello Guys
I have done first marriage in Pakistan and invited her and kids ( which also born outside UK) into UK after meeting earning threshold and other home office requirments . I applied multiplt extensions for them. Few months before, I divorced her in Pakistan after applying in Pakistan local council not through Pakistan court. I sent pakistani divorce letters to her UK Address. After getting divorce certificate , i updated my divorced status in Pakistan national database ( NADRA).
Now i want to marry soon and i want to bring my second wife into UK as my ex wife and kids are in UK. Anybody can guide me in this regard?.

Provided your second marriage took place after the date of the decree absolute of the first marriage's divorce, I believe that you can.

Problems will arise if your second marriage took place before the date of the decree absolute of the first marriage's divorce. In that case, the UK will take the view that you were not "free to marry" at the time of the second marriage and hence will not recognise it for immigration purposes.

Also, if your first wife is in the UK on a spousal visa, have you informed the Home Office that your first marriage has ended and that you are no longer in a subsisting relationship with your first wife?

I am still in Pakistan after divorcing the ex wife residing in UK. Also i have not informed home office and i have not applied divorce in UK. Is there any need to apply divorce in UK as i already have Pakistani divorce certificate?.

I think you need to do that first, as otherwise the Home Office records will show that you have a wife that you have already sponsored already living in the UK.

To the best of my knowledge, there is no need. However, I do not know the intricacies of family law (which is what this is) and would wait for others to respond to this point.

This will tell you the minimum you must now pay towards the maintance of your children in the UK.

Your wife in the UK can go to the Child Maintenance Service for them to collect this money from you directly, or from your employer to collect this by deducting from your wages before they are paid to you, or from any UK benefits.

Or by going to the government of any REMO country you are living in. Pakistan is on that list.

Yes you are right Pakistan is in that list. Can she apply maiontenance from UK in Pakistan ?. If yes. then how much i have to pay her? Is it on the basis of UK earning or on the basis of Pakistani earning?.

(I was giving maintenence to my ex wife and before coming Pakistn i informed child maint dept i am leaving UK not sure when i come back i am not paying to her)

Yes, I read your history after I posted and thought that a womens refuge might have advised your wife to go to the Child Mainentance Service, for them to collect the payments for your children.

Why have you stopped paying towards your childrens keep? You don't have a choice about not paying for your children. If it is already with the Child Maintenance Service, don't build up debt, they have a lot of powers. They can apply to the courts to have you disqualified from driving, take your passport etc. Keep in touch with them.

If you are now living and working in Pakistan, they can apply for a REMO for Pakisatan to collect the debt. If you are now living in Palistan, how will you be able to sponsor your new wife for a visa?

I stop paying CM because there was no money in my account to pay her.
(1)How CMS informed me they want to take action against me taking back nationality and driving license as i am in pakistan?.
(2)According to remo list , am i only liable for UK earning? What about pakistani earning ?,
(3)What about assets in Pakistan, can she claim from UK according to UK law or can she claim when i come to uk as divoced certificate has been issued by pak union council not by court?
I want to bring my future wife in UK but dont want to put me in troubile as she is very hostile with me

They won't be taking back your nationality, they will be cancelling your passport, for upto two years, if so ordered by a court.

They will likely notify you by letter sent to your UK address to return your UK passport to them. And even if you don't, if you use the passport to enter the UK, the Immigration Officer at the airport can impound the UK passport.

Without knowing much about REMOs, it seems that it is a reciprocal agreements for courts of one country to enforce the judgments of another. It would therefore be upto the courts to decide which earnings to take into account. And I think that the UK courts at least will likely take into account your earnings and assets globally.

Again, these matters are family law related and you may want to consult a family law forum or solicitors.

From an immigration law point of view,
(a) notify the Home Office of your divorce,
(b) if your first wife is so particularly hostile, don't give her the ability to have your British passport suspended/cancelled by not paying the child maintenance.

The CMS works to protect the children. Child Maintenace is the contribution of a parent to the welfare of their children. If the child maintenance isn't paid, the childs welfare can suffer.

As the CMS is one of the services that has to be paid for by the are people who use it, once the direct pay ends and the CMS start collecting or taking action, they add their charges.
