Skilled Worker Visa - Maintenance marked as No

Hi All,

I had finished my biometrics last Monday (25/10/2021). I received a mail on Friday from the Home Office for information regarding the application with respect to Maintenance.

I moved to the UK on December 12 2020 on an ICT visa. I am switching jobs now and the new employer has raised Tier 2 Skilled worker visa for 5 years.

I have been asked to update details on Maintenance by the Home Office. Since it's been only 10 months in the UK they are asking for more documents to prove Maintenance. In the CoS it's given as "N" for the maintenance question but the employer tells me they will sponsor my Maintenance. I do not have 1200 in my bank account for the last 30 days. I have mailed worksponsordocumentrequests explaining the same. Am extremely worried, any help on this would be very helpful. Thanks in Advance.

This is a tricky situation and if no action is taken your visa application will be refused and the visa fee lost.

Suggest to ask the HO to delay making a decision on your application until 12 Dec when you will have completed 12 months in the UK. You will of course need to clear this with the sponsor.

Alternatively, provided the status of the CoS in the SMS is still shown as "assigned" rather than "used" it may, repeat may, be possible to add a sponsor note changing the answer to the maintenance question from NO to YES.

How do I ask the HO to hold the decision ?

Will check with the sponsor on the SMS system

Just an update , my employer has confirmed they have added sponsor comment . Will that be sufficient ? Will there be any issues ? Thanks in advance

If the employer added a sponsor note to your CoS which had an "assigned" status this should hopefully be acceptable to the HO

Write to the HO by whatever means of communication they suggested (email?) confirming that the employer added a sponsor note to the CoS certifying maintenance but should this not be accepted ask for the decision on your application to be delayed until 12 Dec by which time you will have completed 12 months in the UK.

Yes I have already mailed them about this . Will wait for a decision and then try asking to delay the decision till 12th of Dec . Thank you

Your employer needs to liaise with the Home Office on your behalf, to make sure the caseworker understands that they are guaranteeing your maintenance.
