ILR qualifications questions

Post by eghe » Wed Nov 03, 2021 8:04 pm

I am asking for a close friend

She came to UK on spouse visa March 2017, (her husband has ILR since 2014)and renew on 2 extension Oct 2020. Since then she has not heard from HO her leave has not been granted. She has complained to MP ...still HO said they are still working on it. She is on employment since arrival to UK. She has 3 kids born in the UK. First born 2017, second 2019, 3rd child 2021.

The question is will she qualify for Indefinite leave to remain in March 2022? And which process is advisable pls?

She is extremely confused please your inputs are valid and valuable. Thank you.

Did she include the appropriate A2 or above English language requirement for her extension?

Yes. If she made an in-time valid application, then Section 3C extended her leave after its expiry date. If they haven’t decided by the time she’s eligible for ILR in March 2022, then she may also vary her application to SET(M), subject to meeting the requirements, including KoLL, etc. Then she may also expect a refund of her FLR(M) fees.

Thank you very very much. I will feedback to her. Do you know any reason why it was delayed till now. She did her A2 English test and they both earn above £50k pounds and no issues so far with the family. Thank you once again sir/madam.

Who knows?
Shortage of staff?
Covid?
Complex rules?
