Hi,
I am an Indian National and am here in UK on tier 2 dependant visa. I have been in the UK for almost 3.5 years and I can among with my son which leaves both of us just about 1.5 years to get our ILR. My wife has been living in UK for 5 years and she has now qualified for ILR though am not sure if she has got this.
However my relationship with my wife has been severely brokendown due to domestic violence that she has framed on me. The police has not found any evidence to this and hence I was not booked on any criminal grounds. Even though my wife works and earns decently, I have been the sole bread winner of the family and despite she being materialistic I would slog myself and work almost 7 days in a week to make sure all bills and mortgage and shopping is paid by me or rather she wouldn't contribute anything.
As social care and other authorities were involved I was requested to move out of the house which I complied thinking that my son and wife shouldn't be ending up at any refugee home.
After I moved out She applied for non molestation order for a year and am currently living separately and it's been almost 2 months now since I have even had seen or heard from my son.
I recently heard that she has written to the homeoffice to revoke my visa and also submitted for divorce. I can only see one motive in this, that was to rob all my wealth for her maintenance for these many years and leave me stranded.
I cannot live without my son and I cannot even imagine being deported from this country if my visa is revoked. I tried to seek help from my company to give me a tier2 visa but since I do not fall in the short skilled jobs category I won't get one.
Is there anyway I can apply for FLR M or FLR FP because my son is here, please note that he is not a british citizen nor he has lived here for 7 years since we both came together. Am more than willing to pay for all his expenses, and do everything for him and I also have all the proof of everything that I have paid so far for the family.
Am extremely depressed with this situation that I am in and I would appreciate any help/advise. Is there anyway I would be able to stay in this country on human rights clause?
